Federal Contract Compliance Programs Announce Change in Posting of Notices

by
Shawn D. Lochinger

July 2001

The Office of Federal Contract Compliance Programs ("OFCCP") has announced that beginning immediately, Government Contractors/Subcontractors must post notices advising their employees that they have a legal right to withhold part of their union dues. This poster, more commonly known as "the Beck Poster," informs non-union employees who pay periodic union dues as part of an Agreement with a Union that they can refuse to pay any part of the dues which do not support collective-bargaining, contract administration, or grievance procedures. Presently, the OFCCP does not have any preprinted posters that can be used by Contractors/Subcontractors. The OFCCP has indicated that it will issue an "official" poster sometime late in 2001. As a final note, however, the OFCCP has also announced that the lack of a preprinted poster will NOT obviate the need for Contractors/Subcontractors to post a notice immediately.

Any Contractors/Subcontractors in need of assistance in posting a temporary notice should contact the Rhoads & Sinon Employment & Labor Law Group.
