Toxic Mold

Mold has become one of the biggest, new liability concerns that businesses face. How companies can best protect themselves from mold litigation and possible business interruption and relocation due to mold is a hot topic that all businesses should be aware of. Anyone from design architects, engineers and contractors to building owners, property managers and tenants can be affected by the growth of toxic mold in a commercial or residential setting. Insurance companies also have been affected by the recent growth of mold litigation, and it seems no one is safe from mold's quickly spreading tentacles.

Mold problems are typically traced to some construction defect that allows the influx of water. Builders are often the first suspects of mold infestation and thus builders, and their insurance companies, are typical defendants in such actions. If you have been affected by the growth of toxic mold in a building where you live or work, or if you have claims asserted against you for potential liability for the presence of toxic mold, Rhoads & Sinon can counsel you through this new, growing and complex area of the law.

Rhoads & Sinon's can provide counsel on complex legal and business issues associated with the growth and remediation of mold conditions in residential and commercial structures, including litigation and insurance coverage matters. We provide representation to financial institutions, building owners, tenants, developers, building and construction managers, general and subcontractors, and design professionals regarding mold prevention and, if necessary, remediation. Our attorneys who regularly practice in this area have expertise in multiple disciplines, including environmental law, construction law, real estate law, insurance and employment law, as well as litigation. We can assist our clients by investigating potential sources and appropriate liability for mold growth, overseeing the development and implementation of remediation plans, and litigating liability claims against responsible parties. In addition, we are experienced in litigating insurance coverage and bad-faith claims, and analyzing insurance policies regarding coverage, defending against personal injury claims for toxic torts, and analyzing construction contracts and real estate agreements to determine liability issues.
